We have a chance, right now, to help make New York the first state since Citizens United to pass legislation limiting the influence of big money in politics.

The legislature is considering a fair elections proposal that would lower campaign contribution limits and provide public financing to candidates so they can run for office without a Rolodex full of lobbyists and wealthy friends.

Whether the plan moves forward depends on Governor Cuomo fighting hard for it. He pledged his support for public financing of elections earlier this year. Now we need to let him know we’re counting on him to follow through. So today, a broad coalition of groups including unions, community groups, and business leaders is launching an aggressive campaign to make sure he stands by his word and protects New York’s democracy.

Vermont Senate Votes to Amend

Vermont Poised to Become First State in the Union to Call for Amendment to End Corporate Personhood

Share this image on Facebook to spread the word!MONTPELIER – The Vermont State Senate voted yesterday calling for an amendment to the Constitution that would make clear that corporations are not people. The vote was 26-3. State Senator Virginia Lyons (D) spearheaded the effort, working with Move to Amend in 2011 to introduce a resolution that came back this year.

Vermont is poised to become the first state to call for an amendment to abolish the doctrine known as “Corporate Personhood” which gives corporations constitutional rights meant to protect people.

Hawaii and New Mexico have passed resolutions against the Citizens United v. FEC ruling by the Supreme Court, but the Vermont resolution goes beyond simply overturning that case and aims to remove corporations from the constitution altogether and make clear that money is not speech and that campaign spending and political contributions can be regulated by the government.

“Citizens across the country are putting Congress and the Supreme Court on notice that an amendment is coming. Legislatures can either join the Movement to Amend or get out of the way,” stated Kaitlin Sopoci-Belknap of Move to Amend. “Americans of all political persuasions are on board with an amendment to put We the People in charge of our government, not corporations. It is great to have the Vermont Senate step up to join the cause.”

More than 100,000 CREDO activists, along with 85,000 ColorOfChange members, have called on corporations to stop supporting the American Legislative Exchange Council (ALEC) because of its role in voter suppression. Last week, news broke that Coca-Cola, Pepsi, Kraft Foods and Intuit have all ended their relationships with ALEC — a major step forward in our campaign. But many major corporations are still funding ALEC.

AT&T is one of them. Our friends at Color of Change contacted AT&T to make sure it understood that through its membership in ALEC, it is supporting racially-discriminatory voter ID laws that have the potential to disenfranchise over 5 million people in the upcoming elections. But despite numerous emails and telephone calls, AT&T’s management will not respond. It appears that AT&T executives believe that if they ignore us we’ll simply go away.

AT&T is a well-known household brand. By associating the company with ALEC, it lends legitimacy to a radical organization that is undermining voting rights and our democracy.

AT&T has made a substantial amount of money from consumers who are disenfranchised by voter ID laws — people of color, seniors, and young people.

AT&T has given at least $150,000 to ALEC since 1998. And although the company insists it only funds particular programs at ALEC, AT&T has played a leadership role within ALEC for many years — including serving as a corporate co-chair in California, Connecticut, Louisiana, Mississippi, and Texas as recently as November 2011.

Supporters of discriminatory voter ID laws claim they want to reduce voter fraud (individuals voting illegally, or voting twice). But such fraud almost never actually occurs, and never in amounts large enough to affect the result of elections. What is clear is that voter ID laws prevent large numbers of eligible voters from casting a ballot, and could disenfranchise up to 5 million people.

ALEC’s voter ID laws are undemocratic, unjust and part of a longstanding right wing agenda to weaken the voting blocs that historically oppose Republican candidates. We have to expose the major companies like AT&T that are helping ALEC suppress the votes of millions of Americans before it’s too late.

And the ballot box isn’t the only place where ALEC’s policies are dangerous for Americans.

Florida’s “Shoot First” law has thus far stopped George Zimmerman from being arrested for shooting Trayvon Martin, a 17year-old armed only with a pack of Skittles and an iced tea. ALEC views the Florida “Shoot First” law as a “model” piece of legislation for other states to adopt and it has helped push this dangerous law into over two dozen states, with it under consideration in eight more. The group has also written legislation to impose harsher criminal penalties on juveniles, to privatize education, and to break unions.

AT&T’s financial support of ALEC must end.

Letter to my Congressman About the NDAA

Dear Congressman___________: By voting yes on the NDAA YOU have failed Liberty 101:

Congressman_____, you are complicit in the most egregious evisceration of our Bill of Rights in our lifetime. Your YES vote to the military arrest and indefinite detention of American citizens IN AMERICA is a repudiation of the protections bequeathed to us by the Framers and the Ratifiers under their construction of the constitution.

Your YES vote to NDAA makes a potential enemy of the state of every blogger, activist or organized faction who comes too close to the truth or gains too much of a following.

Your Yes vote to NDAA takes down the shield of the following constitutional protections:

•Article I Section 9, Clause 2’s right to seek Writ of Habeas Corpus;

•The First Amendment’s right to petition the Government for a redress of grievances;

•The Fourth Amendment’s right to be free from unreasonable searches and seizures;

•The Fifth Amendment’s right to be free from charge for an infamous or capitol crime until presentment or indictment by a Grand Jury;

•The Fifth Amendment’s right to be free from deprivation of life, liberty, or property, without Due Process of law;

•The Sixth Amendment’s right in criminal prosecutions to enjoy a speedy trial by an impartial jury in the State and District where the crime was committed;

•The Sixth Amendment’s right to be informed of the nature and cause of the accusation;

•The Sixth Amendment’s right confront witnesses;

•The Sixth Amendment’s right to Counsel;

Your YES vote to NDAA is not just some minor academic argument we can all agree to disagree on and let stand. Your YES vote to NDAA is a 1776 issue.

Your YES vote to NDAA repudiates several of our original grievances with King George and Great Britain found in our Declaration of Independence as follows:

He has affected to render the Military independent of and superior to the Civil Power.

He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation:

For depriving us in many cases, of the benefit of Trial by Jury

For transporting us beyond Seas to be tried for pretended offences

For taking away our Charters, abolishing our most valuable Laws and altering fundamentally the Forms of our Governments

Voting YES to NDAA is an unforgiveable act of treachery. No one who voted YES to NDAA deserves re-election. No matter what you do from here on out, the level of treachery exhibited by you with this single vote puts you on the wrong side of the constitution. Any individual or group who runs interference for you should seriously search their hearts for their own position on individual liberty.

You had the opportunity to make a “bold statement” for LIBERTY. You failed. Instead you turned it into an OJ Simpson moment, erasing with one act of inconceivable evil anything good you may have done before or will do again after this attack on freedom.

That even discussing the possibility of these provisions should come up in the halls of Congress is disgusting enough. For it to be passed with such bipartisan support suggests that time has expired to decide if one stands with The Constitution, Every Issue, Every Time, No Exceptions, No Excuses; or one is more interested in making friends with political insiders and supporting a party agenda.

One opposes tyranny, or one enables it. There is no middle ground and time is not an ally. Wrapping tyranny in the flag and calling it security makes it no less evil.

I call upon you to repudiate your YES vote to NDAA and admit your grievous error.

I also demand you join with Rep. Justin Amash, Rep. Ron Paul, Rep. John Duncan and Rep. Walter Jones and Co-Sponsor HR 3785: To repeal section 1021 of the National Defense Authorization Act for Fiscal Year 2012
